If the government is always spying on us then why are so many criminals convicted only after an official investigation on them was completed ?

So if the government has access to people's search histories , online activity , contacts , webcams , phonecams. Then why are criminals only caught when an official investigation begins on them , if they already have all their stuff then shouldn't it be easy for them to present evidence in the court ?
